These Terms of Service (“Terms”) govern your use of the Empire Land Clearing & Site Development (“Empire,” “we,” “us,” or “our”) website and services. By accessing our website or engaging our services, you agree to these Terms.
Services
Empire provides land clearing, forestry mulching, stump grinding and removal, site preparation, grading, and related services in New York's Capital Region. All services are subject to a written estimate or proposal agreed upon by both parties before work begins.
Estimates & Pricing
All estimates provided by Empire are valid for 30 days from the date of issue unless otherwise stated. Final pricing may be adjusted if site conditions differ materially from what was assessed at the time of the estimate. Any adjustments will be communicated and approved by the customer before additional work proceeds.
Payment Terms
Payment terms will be outlined in your project estimate or contract. For standard residential projects, payment is due upon completion of work unless otherwise arranged in writing. Empire reserves the right to require a deposit for larger projects.
Property Access & Conditions
The customer is responsible for ensuring Empire has adequate access to the project area. The customer must disclose any known underground utilities, septic systems, wells, boundary disputes, or other conditions that may affect the work. Empire is not responsible for damage to underground structures or utilities that were not disclosed or properly marked prior to work commencing.
Permits & Regulations
The customer is responsible for obtaining any required permits, approvals, or variances from local authorities prior to the start of work, unless otherwise agreed in writing. Empire can provide guidance on typical permit requirements but does not guarantee compliance with local regulations on the customer's behalf.
Limitation of Liability
Empire's liability for any claim arising from our services shall not exceed the total amount paid for the specific project giving rise to the claim. Empire shall not be liable for indirect, consequential, or incidental damages. Empire is not responsible for delays caused by weather, permit issues, or other circumstances beyond our reasonable control.
Insurance
Empire maintains comprehensive general liability insurance and workers' compensation coverage for all employees and operations. Proof of insurance is available upon request.
Cancellation
Either party may cancel a scheduled project with at least 48 hours' notice without penalty. Cancellations with less than 48 hours' notice may be subject to a mobilization fee if equipment has already been dispatched or staged.

Governing Law
